Weatpaper Application Privacy Policy

Introduction

Thank you for using the Weatpaper application (the “Application”). This Privacy Policy explains what personal data we collect, how we process it, who we share it with, and what rights you have in relation to it, in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation – “GDPR”). By using the Application, you accept the terms of this Privacy Policy.

What Data Do We Process, for What Purpose, and on What Legal Basis?

We process the following categories of data for specific purposes and on the indicated legal bases:

a) Location Data:

  • What data: Approximate data about your location (latitude and longitude obtained using Android location services, e.g., based on Wi-Fi or cellular networks). We do not request access to precise GPS location unless it is absolutely necessary for a feature to function. The last known location may be temporarily stored locally on your device to ensure service continuity if fetching the current location is not possible.
  • Purpose: To retrieve current weather data for your location from a third-party provider (OpenWeatherMap) in order to adjust the wallpaper displayed by the Application to the prevailing conditions. To ensure the core functionality of the Application. To enable the application to operate in the background for periodic wallpaper updates.
  • Legal Basis: Necessity to perform a contract (providing the weather wallpaper service at your request) – Art. 6(1)(b) GDPR. Your consent expressed by granting the Application permission to access location in the Android system. Storing the last location on the device is based on our legitimate interest (Art. 6(1)(f) GDPR) in providing a better user experience.

b) Analytics and Technical Data:

  • What data: We may collect anonymous or pseudonymized data regarding how the Application is used, device information (e.g., model, operating system version, typical technical data), Application error information (crash logs), and information about internet connection availability. If we use Firebase Analytics, identifiers such as Firebase Installation ID or Advertising ID (if available and the user has not disabled ad personalization) may also be collected.
  • Purpose: Diagnosing technical problems, improving the stability and quality of the Application’s operation, understanding how users utilize the Application for its further development.
  • Legal Basis: Our legitimate interest (Art. 6(1)(f) GDPR) in maintaining and developing the Application. If data collection goes beyond basic anonymous analytics (e.g., using the Advertising ID), the basis may be your consent (Art. 6(1)(a) GDPR), which we will request separately.

c) Data Related to Additional Wallpapers (if the feature is implemented):

  • What data: Information about whether the user decided to download an additional wallpaper pack. Downloaded wallpaper files stored locally on the device.
  • Purpose: Enabling the download and use of additional wallpapers offered by the Application. Managing access to these wallpapers.
  • Legal Basis: Necessity to perform a contract (providing additional content at the user’s request) – Art. 6(1)(b) GDPR.

d) Contact Data:

  • What data: Your email address and the content of correspondence if you contact us directly (e.g., by writing to paweldelinowski@outlook.com).
  • Purpose: Responding to your inquiries, providing technical support.
  • Legal Basis: Our legitimate interest (Art. 6(1)(f) GDPR) in communicating with users or the necessity to take steps at your request before entering into a contract (Art. 6(1)(b) GDPR).

Data Recipients and Third-Party Sharing


Your personal data may be shared with the following categories of recipients:

  • OpenWeatherMap: We share your location data (approximate coordinates) with OpenWeather Ltd. (or its affiliates) to obtain the weather data necessary for the Application to function. Data processing by OpenWeatherMap is subject to their own privacy policy.
  • Google (Firebase / Google Play Services): We use services provided by Google LLC (or its affiliates):
    • Google Play Location Services: Used to acquire location data.
    • Firebase Analytics (if enabled): Analytics and technical data are sent to and processed by Google to provide us with Application usage statistics.
    • Firebase Cloud Storage (if the additional wallpapers feature is implemented): Additional wallpaper files are stored on Google servers, and interactions with this service (e.g., retrieving the file list, downloading the files themselves) are handled by Google’s infrastructure. Data processing by Google is subject to their privacy policy and Firebase terms of service.
  • Public Authorities: We may share your data with authorized public authorities if required by applicable law.

We do not sell your personal data or share it with other third parties for marketing purposes.


Data Transfer Outside the European Economic Area (EEA)

Using the services of OpenWeatherMap and Google (Firebase, Google Play Services) may involve the transfer of your personal data (e.g., location data, analytics data) to servers located outside the European Economic Area (EEA), including in the United States. In such cases, the transfer is based on appropriate mechanisms ensuring GDPR compliance, such as Standard Contractual Clauses (SCCs) approved by the European Commission or adequacy decisions (e.g., under the EU-US Data Privacy Framework, if the respective provider participates in it). More information about the safeguards applied by our providers can be found in their privacy policies.


Data Retention Period

  • Location data is processed on an ongoing basis to retrieve weather and is not stored by us long-term, except for the last known location saved locally on your device, which is stored until it is overwritten by a newer location or the Application data is cleared.
  • Analytics data (e.g., in Firebase Analytics) is stored for the period necessary for analytical purposes, according to the service settings (by default, this might be, for example, 14 months).
  • Downloaded additional wallpaper files are stored locally on your device until deleted by you (e.g., by clearing the Application data or if we provide such a feature).
  • Contact data is stored for the period necessary to conclude the correspondence or resolve the reported issue.
  • Data may be stored longer if required by law or necessary for the establishment, exercise, or defense of legal claims.

Your Rights Under GDPR

In connection with the processing of your personal data, you have the following rights:

  • The right of access to your data.
  • The right to rectification (correction) of data.
  • The right to erasure of data (‘right to be forgotten’).
  • The right to restriction of processing.  
  • The right to data portability (to receive the data in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller).  
  • The right to object to processing based on our legitimate interest.
  • The right to withdraw consent at any time if processing is based on consent (withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal). You can withdraw consent for location access in the Android system settings.  
  • The right to lodge a complaint with a supervisory authority – the President of the Personal Data Protection Office (UODO), ul. Stawki 2, 00-193 Warsaw, Poland.

How to Exercise Your Rights?

Data Security

We strive to protect your personal data from unauthorized access, loss, or destruction by using appropriate technical and organizational measures. However, please remember that no data transmission over the internet or data storage system is 100% secure.

Intellectual Property of Wallpapers

Wallpapers provided within the basic version of the Application come from sources recognized as providing content under licenses permitting their use (e.g., Pexels, Unsplash). We make efforts to use them in accordance with the license terms. Additional wallpapers (if the feature is implemented) will come from similar sources or will be created specifically for the Application. If you have reasonable suspicion that any wallpaper infringes copyright, please contact us.

Children’s Privacy

The Application is not intended for children under the age of 16. We do not knowingly collect personal data from individuals under this age. If you become aware that your child has provided us with personal data without your consent, please contact us.  

Changes to This Privacy Policy

We reserve the right to make changes to this Privacy Policy. We will inform you about any significant changes by publishing a new version of the policy on this page and/or within the Application. Your continued use of the Application after changes are made constitutes your acceptance of them. We encourage you to review this Privacy Policy regularly.
